General Terms and Conditions of Service

OVERVIEW

Welcome to BeGood! The terms “we”, “us”, and “our” refer to BeGood. BeGood operates this store and website (the "Site"), including all information, content, functionality, tools, products, and related services, in order to offer you a curated shopping experience (the “Services”). BeGood is Powered by Shopify, which allows us to provide the Services to you. These terms and conditions, along with any policies referenced herein (the “Terms of Service” or “Terms”), describe your rights and responsibilities. By visiting, interacting with, or using our Services, you agree to the application of these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use or access our Services.

SECTION 2 - ACCESS, ACCOUNT AND CONSUMER PROTECTION

By accepting these Terms, you represent that you have reached the age of majority in your State of residence and that you have given us your consent to allow any of your minor dependents to use the Services on your devices. You are solely responsible for maintaining the security of your account credentials. You may not transfer, sell, or assign the account to third parties. 

Nature of the relationship (B2C vs B2B): In accordance with current laws, the economic relationship between the Supplier and the Customer is governed by consumer protection legislation exclusively if the Customer purchases for personal purposes. Consumer protection regulations (e.g., Legislative Decree 185/1999 on distance contracts and the right of withdrawal) do not apply to relations with Customers purchasing for purposes related to their business activity (providing a VAT Number). You also declare that B2C purchases are intended for personal use and not for commercial resale.

SECTION 3 - OUR PRODUCTS AND SERVICES

Through our e-commerce, we provide a virtual shelf. We have made every effort to provide an accurate representation of our products; however, colors or appearance may differ due to your screen settings. We do not guarantee that the appearance or quality of the products will meet your visual expectations. We reserve the right to modify product descriptions, discontinue the sale of any item at any time, or limit the quantities offered to single individuals or geographic areas.

SECTION 4 - PRICES, BILLING AND PAYMENTS

Unless otherwise indicated, all prices indicated are VAT included and expressed in Euros. Prices may vary without notice. You agree to provide updated and complete billing information. Payment must be credited in full. Accepted methods include:

  • PayPal and Credit Cards: (Visa, Mastercard, Diners Club, American Express).

  • Prepaid Card: (e.g., Postepay, with charges borne by the Customer).

  • Stripe: (only for Switzerland).

  • Scalapay: (For Austria, Belgium, Netherlands, Finland, France, Germany, Italy, Portugal, Spain). You receive the order immediately and pay in 3 installments. You acknowledge that the installments will be transferred to Incremento SPV S.r.l., to related parties and their assignees, and you authorize this transfer.

SECTION 5 - ORDERS

When you place an order, you present an offer to purchase. Each order is marked with a unique code. BeGood reserves the right to accept or reject the order at its own discretion. In the event of cancellation or modification due to unavailable material, you will be contacted via e-mail.

SECTION 6 - SHIPPING AND DELIVERIES

We entrust shipments to selected express couriers. Once the products are transferred to the courier, ownership and risk of loss pass to you.

  • Italy: €8.95 (Free over €100). For minor islands, the Venetian lagoon, and disadvantaged areas, the flat rate is €35.

  • Abroad: €16.95 (Free over €150). For foreign minor islands or disadvantaged areas, the flat rate is €35.

  • Indicative times: 4/5 working days (excluding Saturdays, holidays, and causes of force majeure). Courier delays are not attributable to us.

  • Verification upon delivery: The Customer must verify the integrity of the packages. Any discrepancies must be noted on the courier's document. Any product defects must be reported within 10 days of delivery via Registered Letter.

SECTION 7 - RIGHT OF WITHDRAWAL AND RETURNS

The private consumer (without a VAT number) can withdraw from the contract within 14 working days of delivery by sending a communication to customer.care@begood.store. The withdrawal is subject to the following rules:

  • Underwear items (Socks, Tights, Knee-highs, Girdles, Culottes, Thongs): Must not have been opened, used, or worn for hygiene reasons.

  • Apparel items (Leggings, Tops, Tank Tops, Sweatshirts): Can be tried on immediately but returned intact in the original packaging with tags.

  • We do not refund products that have odors (smoke, perfume, detergent) or signs of wear.

  • We do not exchange sizes/colors (a new order is required).

  • Return shipping is at the customer's expense and risk. Cash-on-delivery parcels are not accepted.

  • The refund (excluding initial shipping costs) will be made within 30 days to the original payment method.

SECTION 8 - RELATIONSHIP WITH SHOPIFY

BeGood is supported by Shopify, which provides us with the e-commerce infrastructure. However, sales take place directly with BeGood. You acknowledge and agree that Shopify is not responsible for any aspect of the sales between you and BeGood. You expressly release Shopify from any claim or liability arising from your purchases.

SECTION 9 - INTELLECTUAL PROPERTY AND PROHIBITED USES

Our Services (trademarks, texts, graphics, logos) are the property of BeGood or its licensors and are protected by copyright laws. It is prohibited to reproduce, copy, sell, or exploit any part of the Services without authorization. Furthermore, it is strictly prohibited to:

  • Use the site for unlawful or defamatory purposes, or to transmit viruses and malware.

  • Use robots, spiders, scraping tools, or artificial intelligence (AI agents) to extract data from the site.

SECTION 10 - AGENTS (BOTS AND AI)

If you use an Agent (autonomous/semi-autonomous software) to interact with the Services, it must clearly identify itself in the HTTP header as “Agent/[agent name]” and must not attempt to circumvent CAPTCHA systems or mimic human behavior. We reserve the right to block any Agent.

SECTION 11 - OPTIONAL TOOLS AND THIRD-PARTY LINKS

We may offer you access to third-party tools or links (e.g., social networks). We provide these tools "as is", without warranties. Any use of these tools or browsing on external sites is at your own risk and discretion.

SECTION 12 - PRIVACY

All personal data collected is subject to our Privacy Policy (available in the Legal Notes & Cookie section). Since the site is hosted by Shopify, your data will also be shared with and processed by Shopify in accordance with their policies to allow the provision of the service.

SECTION 13 - FEEDBACK, ERRORS AND OMISSIONS

If you send us suggestions, reviews, or ideas ("Feedback"), you grant us the right to use them without restrictions or obligation of compensation. Typographical errors or inaccuracies regarding prices and availability may occur. We reserve the right to correct such errors and to cancel orders at any time, even after submission.

SECTION 14 - DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS". WE DO NOT GUARANTEE THAT THE USE OF THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. To the maximum extent permitted by law, BeGood, its directors, employees, and Shopify cannot be held liable for direct, indirect, punitive, or consequential damages (including loss of profits or data) arising from the use of the Services or the purchase of products.

SECTION 15 - INDEMNIFICATION, SEVERABILITY AND TERMINATION

  • Indemnification: You agree to indemnify BeGood and Shopify against any claim or demand from third parties due to your violation of these Terms.

  • Severability: If any clause is found to be unenforceable, the remaining provisions will remain valid.

  • Termination: We may suspend or terminate your access to the Services at any time if you violate these Terms.

SECTION 16 - GOVERNING LAW AND JURISDICTION

The Purchase Contract is concluded in Italy and governed by Italian Law. For any dispute (without prejudice to the mandatory provisions protecting the consumer), the Judicial Authority of the Court of Bergamo will have exclusive jurisdiction.

You can consult the current version of the Terms on this page. We reserve the right to update or modify these conditions by publishing updates on the website. The continued use of the Services constitutes acceptance of such modifications.
